Project fees, deposits, retainers, payment schedules, and other payment terms will be stated in the applicable quote, service confirmation, invoice, contract, or service agreement.
Clients are responsible for all charges associated with the requested services, including any applicable taxes, processing fees, travel expenses, equipment charges, expedited service fees, vendor expenses, or other agreed-upon costs.
The Varallo Group LLC may require payment, a deposit, or authorization of a payment method before scheduling personnel, reserving equipment, beginning work, or delivering completed materials.
Amounts not paid when due may be subject to late fees, collection costs, or other charges when permitted by the applicable service agreement and governing law.
Cancellations, Schedule Changes, and Refunds
Except as required by applicable law or expressly stated in a written service agreement, all deposits, retainers, advance payments, and payments for services that have been scheduled, reserved, started, or completed are nonrefundable. Refunds will not be issued for services that have already been performed or rendered, whether in whole or in part.
Cancellations or schedule changes must be received by The Varallo Group LLC before 5:00 p.m. Eastern Time on the business day immediately preceding the scheduled proceeding or service. A business day is Monday through Friday, excluding federal and Massachusetts state holidays.
Any cancellation or schedule change received after 5:00 p.m. Eastern Time on the preceding business day, or at any time on the scheduled service date, will be billed a cancellation or schedule-change fee.
Cancellation and schedule-change fees apply because The Varallo Group LLC commits personnel, preparation time, travel arrangements, vendors, technology, and equipment in advance of the scheduled service. The applicable fee will be based on the services and resources reserved and may be stated in the relevant quote, rate sheet, scheduling confirmation, invoice, contract, or service agreement.
Additional charges will apply if personnel have already begun traveling to the scheduled location, have arrived at the location, or have incurred other nonrecoverable expenses. These charges may include travel time, mileage, parking, lodging, equipment rentals, vendor charges, preparation time, and other costs reasonably incurred in connection with the scheduled service.
A cancellation received before the deadline may avoid the cancellation or schedule-change fee. However, a timely cancellation does not make deposits, retainers, advance payments, or other nonrefundable payments eligible for a refund.
Cancellation and schedule-change requests must be submitted using the contact information provided in the scheduling confirmation or service agreement. The client is responsible for confirming that The Varallo Group LLC received the request before the deadline.
Nothing in this section limits any cancellation or refund rights that cannot legally be waived.
Client Responsibilities
Clients are responsible for providing accurate scheduling information, service requirements, locations, contact details, access instructions, case materials, specialized terminology, equipment requirements, and other information reasonably necessary for The Varallo Group LLC to perform the requested services.
The Varallo Group LLC is not responsible for delays, additional costs, or service limitations resulting from incomplete, inaccurate, or late information provided by the client or another party involved in the proceeding.
Events Beyond Our Control
The Varallo Group LLC will not be responsible for delays, interruptions, or failures caused by events beyond its reasonable control. Such events may include:
- Severe weather or natural disasters.
- Illness, emergencies, or transportation disruptions.
- Venue closures or access restrictions.
- Power, internet, telecommunications, or technology failures.
- Acts or omissions of third-party providers.
- Government actions or public emergencies.
- Labor disputes, civil disturbances, or other unforeseen events.
When reasonably possible, The Varallo Group LLC will work with the client to identify an alternative arrangement. Alternative arrangements may be subject to availability and additional charges.
